Terms and conditionsThese terms and conditions have been constructed to comply with the relevant law with the assistance of our legal advisors. Definitions:COMPETITION: The Competition operated by the Promoters to which these Terms and Conditions Apply, wherein the Entrants submit entries via the Website www.winadreamhomeinthesun.com to win the Prize. PRIZE: The funds necessary to complete the transfer of the Property from the Promoters to the Winner. These funds include the purchase price of the property, VAT, stamp duty, all property transfer taxes, notary fees and all conveyancing fees which will be carried out by the Promoters’ solicitor in Spain on behalf of the Winner. The Winner acknowledges that the Promoter's UK solicitor will pass the Prize to the conveyancing solicitor, on the Winner's behalf, at the appropriate time in the conveyance process solely for the purpose of completing the Property transfer. No cash alternative is available and these funds are not available for any other purpose save as set out in conditions 43 to 45. PROMOTERS: Beverly and Andy Rockliffe (“the Promoters”). General1. By entering the competition via the Website, Entrants are deemed to have read and accepted these Terms and Conditions and agree to be bound by them. 2. Upon entering the Competition, all Entrants must submit all contact details requested by the Promoters (which must include a valid e-mail address) which will be used for the following purposes: (a) to notify the Winner that they have won the Prize; (b) to notify Shortlisted Entrants in the event of a tie break being necessary, (c) to post the Winners name and town of residence on the Website; and (d) to comply with the Privacy Policy (see 5 below). 3. All entrants are solely and completely responsible for providing the Promoters with accurate and current contact details. 4. The Promoters will be in no way liable for any failure or inability to make contact with any Entrant due to any errors, omissions or inaccuracies in the contact details provided by the Entrants or otherwise. All Entrants must notify the Promoters of any change in the contact details that are provided to the Promoter where that change occurs between the time of entering the competition and the winner being announced. The Promoters reserve the right to discount and disregard any entry where any contact information is inaccurate or invalid. 5. Privacy policy - The Entrants and the Promoters recognise that the Promoters may use contact details and other data including personal data as defined by the UK Data Protection Act 1998 supplied by the Entrants to the Promoters to administer the Website and conduct the Competition according to these Terms and Conditions. The Entrants and the Promoters also recognise that the Promoters may (either by choice or at the request of a third party) also disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons. 6. By entering the Competition, the Entrants consent to receiving notifications and Competition updates from time to time, by email. Entrants may unsubscribe from these email updates at any time. 7. The Competition is operated by the Promoters. 8. The Competition is open for entry to all persons aged 18 or over excluding the Promoters, their family, agents, employees, professional advisers or anyone else connected with the development or operation of the Website or administration of the Competition in any way, shape or form. 9. The Promoter also reserves the right to refuse to accept or consider an entry where the Promoter considers it prudent to do so in the interests of preventing crime, protecting vulnerable persons and promoting social responsibility. 10. Where the Promoter refuses to accept or consider an Entry or where the Entry Fee is returned for whatever reason, the Promoter shall have no further liability to the Entrant or to any other person. 11. Entries made by the Entrants to the Competition will only be valid if manually made via the Website. 12. By entering into the Competition, all Entrants acknowledge that their payment of £25.00 (GBP) per entry to answer the Questions and thereby enter the Competition does not guarantee in any way that they will win the Competition. 13. The Promoters do not give any guarantee or warranty as to the value of the Prize or the condition of the Property. 14. Only completed Entries will be entered into the Competition. 15. As a condition of entering the Competition, Entrants must ensure that, by doing so, they do not contravene any laws of their country of residence. The Promoters will not be liable in any way if an Entrant enters the Competition unlawfully. 16. The Entrants recognise that the Competition is a prize competition and to win the Competition via answering the Questions depends on the exercise of the skill, judgment and knowledge of the Entrants and that the Prize is not allocated by chance. 17.By entering the Competition, Entrants warrant that all information which they submit is accurate, true, current and complete. The Promoters reserve the right to disqualify any entrant (entirely at their own discretion) if there are reasonable grounds to believe the Entrant has acted in breach of any of these Terms and Conditions. 18. There is an upper limit of a maximum of 200 Entries that any one household can make via this Website. 19. The Promoters are not liable in any way for any property valuation and make no representation or warranty in respect of its accuracy. 20. All Entries will become the property of the Promoters on receipt and will not be returned. 21. Entrants will receive a confirmation e-mail/receipt from the Promoters within 72 hours of receipt of their Payment and Entry into the Competition. 22. It is the sole responsibility of each Entrant to retain a copy of the confirmatory e-mail referred to above for their future reference. 23. The Promoters reserve the right to amend these terms and conditions at any time and for any reason. The Prize24. The purpose of the Competition is to win the Prize. 25. The Property will be transferred by the Promoters to the Winner of the Competition free from all mortgages and charges on the property, at the Promoters’ expense and including all conveyencing fees, charges and taxes. 26. The Winner shall ensure that the solicitor registers the Property at the Land Register in the Winner’s name. The Competition27. Payments will only be accepted in pounds sterling. 28. Entrants may submit their Entry in English or a language using the Roman alphabet. 29. The process to determine the Winner will begin the day after the Closing Date and a final decision will be made within 14 days of that date although if Shortlisted Entrants are identified the final decision may be extended as necessary - see clause 36. 30. The price of entering the Competition is £25.00 (GBP) per Entry and is payable using the "Pay Now" button on the payment form of the Website. 31. In answering the Questions, the Entrant recognises that they must exercise skill and judgement to give the correct answers. 32. Entry into the Competition will not be concluded until the Entrant answers all the Competition Questions, provides their contact details (including postal and e-mail addresses plus telephone number) and card payment details. The Entrant’s card payment will be electronically processed. 33. Entry to the Competition will only be confirmed on approval of the payment and by the sending of the confirmation e-mail/receipt as described above by the Promoters to the Entrant to confirm their entry into the Competition. 34. The Maximum Number of Entries has been calculated based on an exchange rate of 1.20 euros to the pound. The Promoters reserve the right to adjust the Maximum Number of Entries to reflect any future change in the euro/sterling exchange rate. 35. When the Maximum Number Of Entries or the Closing Date is reached, the Competition will close; however the Promoters reserve the right to extend the closing date by up to 3 months at their discretion. 36. All Entries to the Competition are final and refunds shall be only made at the discretion of the Promoters including in the case of entries submitted after the Closing Date. 37. The Winner of the Prize will be the Entrant who provides the correct answer to all the Questions. In the event that more than one Entrant provides the correct answer to all the Questions, the Winner will be that Entrant who answered all the Questions correctly in the least amount of time. In the event that this results in more than one Entrant being identified, these Entrants ("Shortlisted Entrants") will be invited by email (using the email address submitted in their newsletter subscription) to answer one or more additional Questions. Shortlisted Entrants must answer the additional Questions within seven days of despatch of the notification email. This process will repeat as many times as necessary until only one Shortlisted Entrant has the correct answer. This person will be the Winner. 38. The Promoters’ decision is final and no correspondence will be entered into about the result of the Competition following the determination of the Winner as described above. 39. The Winner will be required to forward a copy of their passport or driving licence and a utility bill (no more than two months old) to the Promoters or Promoters’ solicitor to prove their identity and to confirm that their Entry was made using a valid debit/credit card belonging to the Entrant or used with the express authorisation of the card holder. The Winner must also provide evidence of their payment receipt and transaction number. 40. Each Entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to this prize competition. 41. If the Winner cannot be contacted by the Promoters within 30 days of being notified of their status as the Winner by e-mail supplied with the contact details submitted in their entry, the Promoters shall be entitled to award the Prize to the Entrant who answered all the questions correctly in accordance with clause 37. 42. The Winner will be required to sign a transfer deed to transfer the Property into the Winner’s name within 28 days of Transfer of the Property. Closing the Competition with less than the Maximum Number Of Entries43. If the number of Entries received as at the Closing Date is not equal to the Maximum Number Of Entries to the Competition, the Competition will close and the proceeds of the Competition will be determined using the formula “number of tickets sold multiplied by the entry ticket price” (“the Entry Fees”). 44. The Promoters will be entitled to retain sufficient funds from the Entry Fees to cover administration and marketing expenditure. The remaining balance following deduction of these expenses is “the Prize Fund”. The Prize Fund will then be distributed to the winning Entrant in place of the Prize. 45. The Winner of the Competition will then be determined in accordance with the method described in clause 37 above. Miscellaneous46. All Entry Fees will be maintained in a separate bank account held by the Promoters until the Winner of the Competition has been determined. The Entry Fees will not be used for any purpose that is not associated with the operation of this competition. 47. The Winner agrees to allow the Promoters to display his or her name on the Website in accordance with the Privacy Policy. The name of the Winner will be posted on the Website for the purposes of announcing the Winner of the Competition within 24 hours of the Winner being determined. 48. Entrants authorise the Promoters to enter their personal details into their database and to use the information in accordance with the provisions of the UK Data Protection Act 1998 and subject to the terms of Privacy Policy. 49. The Promoters reserve the right to cancel the Competition at any time either before or after tickets have been sold. If the Competition is cancelled, the Promoters will return the Entry Fees (less all transaction charges applied by our payment processor) to each Entrant (either by bank card refund, bank transfer or by cheque and in one combined payment where several entries have been made by a competitor). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person. 50. The Promoters make no representation or warranty as to the valuation of the Property, its structural or cosmetic condition or its ability to be sold. Entrants should make and rely on their own enquiries and legal advice about the Property before entering the Competition. 51. Save for death or personal injury the Promoters will not be liable for any loss (including economic loss) suffered to or sustained by any person or property as a result of any act or omission of the Promoters, nor will their servants or their agents in developing, planning and administrating the Competition, distributing the Prize to the Winner or following the distribution of the Prize. 52. The Promoters accept no liability for errors or omissions contained within the Prize details, description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the Winner) to satisfy him/herself as to the accuracy of any such details and/or any content of this Website. 53. The Promoters will not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the Website. 54. The Promoters do not accept responsibility for entries which they do not receive due to failures in computer systems, other malfunctions, high Internet traffic, hardware failure, software failure, server faults or any other reason. It is the responsibility of Entrants to contact the Promoters if they do not receive the combined confirmation email and receipt as described above within 5 days of the submission of any Entry. 55. These competition rules shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoters. 56. An entry shall be declared void (without any refund being given) if the entrant engages in: (a) any form of fraud (actual or apparent); (b) fraudulent misrepresentation; (c) fraudulent concealment; (d) hacking or interference with the proper functioning of the Website, any software utilised by the Promoter or any data that is held in association with the competition; or (e) amending, or unauthorised use of any of the content or code that constitutes the Website. 57. Entrants agree to participate in media interviews if the opportunity should arise. 58. The Prize offered will be accepted in the knowledge that the Winner may become liable for tax contributions and any Prize awarded may have to be declared in tax return(s) as required by law. Any tax liability will be the responsibility of the Winner. 59. Each entrant should retain a copy of these Terms and Conditions for their future reference. Version 1.2
